TERMS OF USE, DISCLAIMER AND COMMUNITY GUIDELINES
Welcome to Separation Preparation (“the Program”).
By purchasing, accessing, or using the Program, website, online community, resources, downloads, or related services (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
If you do not agree with these Terms, you must not access or use the Services.
1. Educational Purposes Only
Separation Preparation is an educational program designed to provide general information and practical education relating to separation, divorce, parenting, communication, decision-making, financial preparation, and related topics.
The information provided through the Program is for general educational and informational purposes only.
The Program is not intended to provide advice specific to any individual, family, jurisdiction, or circumstance.
Family law, financial obligations, and separation processes vary significantly between jurisdictions. Participants are solely responsible for obtaining advice appropriate to their specific circumstances and location.
2. No Professional Advice
Nothing contained within the Program constitutes or should be relied upon as:
- legal advice;
- legal services;
- mediation services;
- arbitration services;
- parenting coordination services;
- divorce coaching services;
- counselling;
- psychotherapy;
- psychological services;
- mental health treatment;
- medical advice;
- financial advice;
- tax advice; or
- any other professional advice or service.
The Program is not a substitute for individualized professional advice.
Participants are encouraged to seek independent legal, financial, therapeutic, medical, or other professional assistance appropriate to their circumstances.
3. No Individualized Advice
Participants acknowledge that Separation Preparation is designed to provide general educational information only.
Any comments, responses, discussions, or communications made by Jennifer Aternino, Julie Gill, moderators, guest contributors, or representatives of Separation Preparation, whether within the online community, in comments, emails, webinars, discussions, or otherwise, are intended solely for general educational purposes.
No individualized advice, recommendations, opinions, assessments, or professional guidance is being provided.
Participants remain solely responsible for obtaining professional advice specific to their circumstances and jurisdiction.
4. No Professional Relationship
Participation in Separation Preparation does not create a lawyer-client, mediator-client, parenting coordinator-client, arbitrator-client, coach-client, therapist-client, fiduciary, or any other professional relationship between participants and Separation Preparation, Jennifer Aternino, Julie Gill, guest contributors, or any affiliated individual or organization.
No participant should assume that communications through the Program, website, email, community, or otherwise create any professional relationship.
5. Safety and Crisis Disclaimer
The Program is not intended for situations involving:
- family violence;
- coercive control;
- abuse;
- significant power imbalances;
- stalking;
- threats to personal safety;
- mental health crises;
- suicidal thoughts;
- emergencies; or
- any circumstance requiring immediate intervention.
If you are experiencing immediate safety concerns or are in crisis, you should seek assistance from emergency services, legal counsel, healthcare providers, crisis services, shelters, or other appropriate support resources.
6. Assumption of Risk
Participants acknowledge that discussions concerning separation, divorce, parenting, finances, conflict, and family relationships may be emotionally difficult.
By participating in the Program, participants voluntarily assume all risks associated with participation and accept full responsibility for their own decisions, actions, and well-being.
7. No Guarantee of Outcomes
Separation Preparation makes no guarantees, representations, or warranties regarding any specific outcome or result.
Participation in the Program does not guarantee:
- reduced conflict;
- settlement;
- reconciliation;
- successful co-parenting;
- improved communication;
- legal outcomes;
- financial outcomes; or
- any other particular result.
Individual outcomes will vary.
8. Access to the Program
Participants receive access to the Program for a period of one (1) year from the date of purchase unless otherwise specified.
Access will expire automatically at the end of the applicable access period.
Separation Preparation reserves the right to offer optional subscription, renewal, or community membership opportunities in the future.
9. Refund Policy
Due to the digital nature of the Program, all sales are final.
No refunds will be provided once a participant has accessed any portion of the Program.
10. Online Community
Participants may be provided access to an online community.
Participation is voluntary.
Participants acknowledge and agree that:
- information shared by community members has not been reviewed, verified, or endorsed by Separation Preparation;
- comments made by participants do not constitute professional advice;
- Separation Preparation assumes no responsibility for information posted by participants; and
- reliance on information provided by community members is solely at the participant’s own risk.
11. Community Standards
Participants agree to:
- communicate respectfully;
- maintain confidentiality;
- refrain from harassment, intimidation, discrimination, bullying, or abusive conduct;
- refrain from providing legal, financial, therapeutic, or other professional advice;
- avoid soliciting business or promoting products or services;
- refrain from posting unlawful, defamatory, or misleading content.
Participants further agree not to:
- copy, record, photograph, screenshot, share, or distribute content posted by other members;
- disclose identifying information regarding other participants; or
- use community information outside of the community without consent.
Separation Preparation reserves the sole and absolute discretion to remove posts, suspend accounts, remove community access, or terminate participation without notice or refund.
12. Confidentiality
While Separation Preparation encourages confidentiality within the community, confidentiality cannot be guaranteed.
Participants acknowledge that online communications involve inherent risks and agree not to hold Separation Preparation responsible for disclosures made by third parties.
13. Intellectual Property
All Program materials, including videos, presentations, workbooks, downloads, templates, graphics, logos, trademarks, text, audio recordings, written materials, and other content are the exclusive property of Separation Preparation and are protected by applicable intellectual property laws.
Participants are granted a limited, personal, non-exclusive, non-transferable licence to access and use Program materials for their own personal, non-commercial purposes only.
Participants may not:
- reproduce;
- record;
- share;
- copy;
- distribute;
- publish;
- modify;
- sell;
- sublicense;
- publicly display;
- create derivative works from; or
- otherwise exploit
any Program materials without prior written consent.
Participants may not upload Program materials to artificial intelligence platforms, use Program materials to train artificial intelligence systems, or generate derivative works using artificial intelligence technologies.
14. Account Security
Participants are responsible for maintaining the confidentiality of login credentials.
Sharing accounts or permitting unauthorized access is strictly prohibited.
Participants are responsible for all activity occurring under their accounts.
15. Limitation of Liability
To the fullest extent permitted by law, Separation Preparation, its owners, directors, employees, contractors, affiliates, contributors, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or relating to participation in the Program or reliance upon Program content.
16. Release
To the fullest extent permitted by law, participants voluntarily release, waive, discharge, and hold harmless Separation Preparation, Jennifer Aternino, Julie Gill, guest contributors, contractors, moderators, affiliates, and representatives from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or related to participation in or reliance upon the Program, website, online community, or related Services, except where prohibited by law.
17. Indemnification
Participants agree to indemnify and hold harmless Separation Preparation and its owners, affiliates, contractors, and contributors from and against any claims, liabilities, damages, costs, expenses, or legal fees arising from their use of the Program or violation of these Terms.
18. Technology and Service Interruptions
Separation Preparation does not guarantee uninterrupted access to the Program.
Separation Preparation shall not be responsible for interruptions caused by internet outages, software failures, platform outages, cyber incidents, maintenance, acts of God, or circumstances beyond its reasonable control.
19. Modification of Program and Terms
Separation Preparation reserves the right to modify, update, suspend, discontinue, or replace any aspect of the Program or these Terms at any time.
Continued use of the Program constitutes acceptance of any revised Terms.
20. No Duty to Respond or Provide Support
Participation in the Program does not entitle participants to direct access to Jennifer Aternino, Julie Gill, moderators, or any other representative of Separation Preparation.
Separation Preparation does not guarantee responses to questions, comments, emails, or community posts.
The Program is self-directed and educational in nature.
Separation Preparation assumes no obligation to provide ongoing support, coaching, consultation, crisis intervention, individualized guidance, or responses to participant inquiries.
Communications sent through the website, email, online community, or any other platform associated with Separation Preparation are not monitored continuously and should never be used for urgent, emergency, crisis, or time-sensitive matters.
21. Community Monitoring and Safety
The online community is not monitored continuously or in real time.
Separation Preparation does not guarantee immediate review, response, intervention, or removal of content.
Participants acknowledge that community discussions should never be used to seek urgent, emergency, or time-sensitive assistance.
Separation Preparation is under no obligation to intervene in disputes between participants.
Participants are encouraged to report inappropriate conduct; however, Separation Preparation makes no guarantee regarding the timing or outcome of any review.
Participants acknowledge that they are solely responsible for all decisions made during or following participation in the Program and agree not to rely exclusively on information obtained through the Program or community when making legal, financial, parenting, or other significant decisions.
Separation Preparation is not responsible for communications, relationships, interactions, or disputes between participants, whether occurring within or outside the platform.
Access to the online community beyond the initial Program access period, if offered, may be subject to separate terms, fees, subscription arrangements, or eligibility requirements.
22. Professional Credentials
The professional credentials, designations, and experience of Jennifer Aternino, Julie Gill, and any guest contributors are provided for informational purposes only and shall not create any professional duty, standard of care, fiduciary obligation, or professional relationship with participants.
23. Guest Presenters
Any guest presenters, experts, or contributors participate in an educational capacity only. The opinions expressed by guest contributors are their own and do not necessarily reflect the views of Separation Preparation.
24. No Warranties
The Program, website, community, and all related materials are provided on an “as is” and “as available” basis.
Separation Preparation makes no representations, warranties, or guarantees, express or implied, regarding the completeness, accuracy, reliability, availability, suitability, or uninterrupted operation of the Program or any content contained therein.
To the fullest extent permitted by law, Separation Preparation disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
25. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
26. Entire Agreement
These Terms constitute the entire agreement between the participant and Separation Preparation relating to the use of the Program and supersede all prior discussions, communications, understandings, representations, or agreements, whether oral or written.
27. Governing Law
These Terms shall be governed exclusively by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
